The law 6/22 on equality of tract establishes the legal frame to combat the discrimination and promote the equality of tract and of opportunities in Andorra. This law prohibits the direct or indirect discrimination based at factors how the genus, the age, the race, the sexual orientation, the religion, among of other. It establishes the laws and responsibilities of the individuals and the organisations to guarantee the equality of tract at the fit at the occupancy, the nurture, the public kicks and other fields of the social and labour life. Besides, the law foresees mechanisms for the protection and the repair at case of discrimination, as well as the promotion of the awareness and the sensitisation on this question at the Andorran society.
It applies at all the companies, independently of his size or sector of activity. It is responsibility of the companies conform with the disposals of this law and take the necessary sizes to guarantee the equality of tract and of opportunities at his labour and social field.
The companies of less of 50 workers also have to conform with the disposals of the law 6/22 on equality of tract in Andorra, including the article 56 that regulates the processes of selection of personnel. Although they can have a smaller structure, these companies also are obliged to assure that there is not discrimination at the processes of selection and at providing the necessary training at the personnel commissioned of these processes. The law does not make distinctions at function of the size of the company when treats to guarantee the equality of tract and of opportunities.
Besides, this article requires that the companies adopt sizes to prevent and combat the discrimination at this field, assuring a process of impartial selection and based at the merit and the competences of the candidates. At case to detect discrimination at the processes of selection, the companies can be object of sanctions and obliged to take corrective sizes.
